TERMS AND CONDITIONS OF USE (EULA)

These Terms and Conditions of Use (hereinafter referred to as the “Terms”) govern the use of the Share a Pix mobile application (hereinafter referred to as the “Application”), developed and operated by its creator (hereinafter referred to as the “Developer”).

By downloading, accessing, or using the Application, the user (hereinafter referred to as the “User”) expressly acknowledges having read, understood, and accepted these Terms in full and without reservation.

1. Purpose of the Application

Share a Pix allows users to send and receive images randomly and anonymously between users. The Application includes a local image analysis mechanism intended to detect potentially sensitive content (NSFW) before transmission.

2. Access and Eligibility

The Application is strictly reserved for users aged 16 years and over. By using the Application, the User certifies that they are of legal age in their country of residence.

The Developer reserves the right to suspend or permanently ban any User who does not comply with these Terms.

3. User-Generated Content

Users may send images via the Application. The User acknowledges and agrees that:

  • They are solely responsible for the images they send.
  • They guarantee that they hold all necessary rights to distribute the images.
  • They guarantee that the images do not violate any applicable laws or regulations.

The User is strictly prohibited from sending, transmitting, or sharing:

  • Illegal content
  • Pornographic or sexual content involving minors
  • Content inciting hatred, violence, or harassment
  • Obscene, defamatory, discriminatory, or abusive content
  • Content that infringes on intellectual property rights

4. NSFW Content Detection and Limitation of Liability

The Application uses local automated image analysis intended to detect potentially sensitive content before transmission. However:

  • This detection is not 100% reliable.
  • The Developer does not guarantee the absence of sensitive or inappropriate content.
  • The User acknowledges that they may receive content that is shocking, offensive, or inappropriate.

The Developer shall not be held liable under any circumstances for any content received via the Application.

5. Disclaimer of Responsibility for Received Content

All content exchanged through the Application is generated by users. The Developer:

  • Does not control content before transmission,
  • Does not moderate content in real time,
  • Does not assume any responsibility for the nature, legality, or consequences of received content.

The User waives any claim, complaint, lawsuit, or legal action against the Developer related to content received through the Application.

6. Reporting Objectionable Content

The Application includes a system allowing Users to report objectionable content.Any reported content may be reviewed and, where applicable, deleted within 24 hours.

The Developer reserves the right to permanently suspend the account of any User responsible for objectionable content.

7. Blocking Abusive Users

The Application includes a mechanism allowing Users to block abusive users. Blocking immediately prevents any further interaction with the blocked user.

8. Zero Tolerance Policy

The Developer applies a strict zero-tolerance policy regarding:

  • Illegal content
  • Sexual exploitation
  • Harassment
  • Hate speech
  • Threats or intimidation

Any violation will result in immediate and permanent account termination without notice.

9. Transfer of Image Rights

By sending an image through the Application, the User:

  • Irrevocably waives all ownership rights to the image,
  • Authorizes recipients to freely use, modify, distribute, or publish the image,
  • Authorizes the Developer to retrieve, reproduce, publish, or display the image on any medium, including websites and promotional materials, without compensation.

This transfer of rights is granted worldwide and for the entire duration of intellectual property protection.

10. Limitation of Liability

To the fullest extent permitted by law, the Developer shall not be held liable for:

  • Any emotional, psychological, or moral harm,
  • Any material or financial loss,
  • Any legal consequences resulting from content received or distributed,
  • Any misuse of the Application by Users.

The Application is provided “as is”, without any warranty of any kind.

11. Data Protection and Privacy

Personal data collected through the Application is governed by the Privacy Policy,available on the official website of Share a Pix. By accepting these Terms, the User also accepts the Privacy Policy.

12. Suspension and Termination

The Developer reserves the right to:

  • Suspend access to the Application at any time,
  • Terminate any user account without notice in case of violation of these Terms,
  • Remove any content deemed objectionable or illegal.

13. Governing Law and Jurisdiction

These Terms are governed by the laws applicable in the jurisdiction of the Developer’s residence. Any dispute shall fall under the exclusive jurisdiction of the competent courts of that jurisdiction.

14. Language and Legal Precedence

These Terms are available in both French and English.

In the event of any discrepancy, conflict, or interpretation issue between the two versions, the French version shall prevail and shall be legally binding.
